TOWN OF NEW CANAAN
NOTICE OF PASSAGE
NOTICE IS HEREBY GIVEN that the Town Council of New Canaan, at a Special Meeting held on April 11, 2006, passed the following legislative acts:
- Approved and enacted an Ordinance Providing for Permitting of Hair and Beauty Shops. In summary, this ordinance provides for inspection and permitting, by the Health Department, of any establishment offering barbering, hairdressing, cosmetology, manicures, pedicures, and/or waxing services; and provides specific standards and requirements for equipment, facilities, maintenance, operation and hygiene. The full text of this ordinance was published in the New Canaan Advertiser on March 30 and April 6, 2006, and a copy is on file in the office of the Town Clerk.
- Approved and enacted Amendments to Ordinance on Sewers and Sewage Disposal. In summary, this ordinance amends Chapter 51 of the Code of the Town of New Canaan by updating the terminology and provisions relating to sewer connections and sewage disposal for the sewer system and septic systems; requires food preparation establishments to install a pretreatment system for removal of fats, oils and grease; and provides for adoption of sewer use rules and regulations by the Board of Finance as the sewer authority. - Approved and enacted an Ordinance Providing for Noise Pollution Control. In summary, this ordinance provides limits and time frames for certain noise producing activities, and authorizes the Town to issue fines for violations. The full text of this ordinance was published in the New Canaan Advertiser on March 30 and April 6, 2006, and a copy is on file in the office of the Town Clerk. The Town Council enacted the published version with amendments to section 3(b) and 3(d), which now read as follows:
(b) Motorized equipment, machinery, or engines powered by electricity, gasoline or other fuel products, including without limitation, snow blowers, snow throwers, leaf blowers, leaf vacuums, lawn mowers, tractors, trimmers, chainsaws, wood chippers, log splitters, and generators, shall be operated at all times with a muffler in working order to abate the exhaust, combustion and explosive noises therefrom. In addition, with the exception of snow blowers and snow throwers, such equipment may not be operated in the following time periods such that the noise therefrom exceeds 45 dBA measured at the receptor’s property line:
Mondays to Fridays: before 7:00 am, or
after 7:00 pm
Saturdays, State or
Federal Holidays: before 8:00 am, or
after 6:00 pm
Sundays: before 10:00 am, or
after 4:00 pm
(d) Noise generated by construction (including demolition) equipment or machinery, such as bulldozers or backhoes, pile drivers, pneumatic tools, or by commercial or domestic power equipment such as, but not limited to, power saws, sanders, grinders, drills, nail guns, air hammers, vacuums, may not be operated in the following time periods such that the noise therefrom exceeds 45 dBA measured at the receptor’s property line:
Mondays to Fridays: before 7:00 am, or
after 7:00 pm
Saturdays, State or
Federal Holidays: before 8:00 am, or
after 6:00 pm
Sundays: before 10:00 am, or
after 4:00 pm
These ordinances as enacted, or as enacted with amendment, will become effective eight days after publication or filing with the Town Clerk (and in the case of the Noise Ordinance after approval by the Commissioner of Environmental Protection), whichever event shall last occur, unless a notice of intent to petition for referendum is filed pursuant to the Charter.
